TERMS OF USE

These Terms of Use ("Terms") govern your access to and use of the nakavo mobile application, website, and related services (collectively, the "Service"), operated by Jontavo LTD ("nakavo", "we", "us", or "our"). By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service.

1. ELIGIBILITY

You must be at least 18 years of age to create an account and use the Service. By using nakavo, you represent and warrant that you meet this requirement and that all information you provide is accurate and current.

2. ACCOUNT REGISTRATION & AUTHENTICATION

Registration is email-based. nakavo uses a passwordless authentication flow — we do not store your password. A secure, time-limited link or code is sent to your email address each time you sign in. You are solely responsible for maintaining access to your registered email address. If you lose access to your email, account recovery may not be possible.

3. DESCRIPTION OF THE SERVICE

nakavo is a travel-focused platform that combines a private trip builder with a public social network. Core features include:

  • Trip Builder — Create and manage private trips, add destinations, itineraries, and invite collaborators.
  • Social Network — A public feed where users discover and share travel experiences.
  • Travel Guide — Create public travel guides starting with a name, description, and cover image, then add locations each with their own cover image. Unlike trips, travel guides and everything in them are public and visible to all nakavo users.
  • Location Photos — Upload photos tied to specific locations; these are public.
  • Trip Attachments — Attach documents (tickets, visas, confirmations) to your private trips.
  • Trip Sharing & Cloning — Share trips to the social feed or clone trips shared by others.

4. TRIPS — PRIVACY & COLLABORATION

Trips are private by default. Only you and users you explicitly invite can view your trip and its contents. By inviting another user to your trip, you grant them access to view and download all trip attachments associated with that trip. You are responsible for ensuring the content you share with invited users is appropriate and legally permissible.

While your trip details remain private, locations are public components of nakavo. Any image you upload into a location's details is public and may be viewed by any user who has a nakavo account, even though the private trip that references that location stays private.

5. TRIP ATTACHMENTS & DOCUMENTS

The Trip Builder allows you to upload attachments (e.g. plane tickets, hotel confirmations, visa copies) to your trips for convenience. We accept no responsibility for the data you store on the Service. You are solely responsible for maintaining your own copies of all original documents. nakavo does not guarantee the permanent availability of uploaded attachments and shall not be liable for any loss, corruption, or inaccessibility of documents stored on the Service. Data may be lost or become inaccessible for reasons outside our control, or as a result of errors in the system. Keeping access to sensitive documents remains solely your responsibility, and you should not rely on nakavo as your sole backup for important travel documents.

Any attachment you upload to a trip is viewable by every member of that trip. Do not upload attachments to a trip unless you are comfortable with all of its members being able to view and download them.

6. PUBLIC PROFILES & THE SOCIAL NETWORK

The nakavo communities are public, and by using nakavo you accept that other users can see your profile from the social network's point of view. Profile information you provide — which may include your first name, last name, and username where you have set these in your account profile information, as well as your display name, bio, and travel activity — is visible to all nakavo users. The social network feed is also public; posts, interactions, and shared trips are visible to all users of the Service, including unauthenticated visitors where applicable.

Location photos you upload are public and may be viewed by any user of the Service. You may remove your own photos at any time; removal takes effect promptly but cached copies may persist briefly.

7. TRIP SHARING & CLONING

7.1 Sharing a Trip to the Social Feed

You may choose to share a trip to the public social network. When you do, a snapshot (clone) of the trip is published at that point in time. This shared version is public and visible to all users. Any subsequent changes you make to your original private trip will not be reflected in the shared version. The shared version is independent of your original trip from the moment of publication.

7.2 Cloning Another User's Shared Trip

Any user may clone a trip that has been shared to the social feed. Cloning creates a new, independent, private trip in the cloning user's account. The cloned trip is entirely separate from the original shared trip; changes to either trip do not affect the other. Trip attachments from the original trip are not transferred to a cloned trip.

8. TRAVEL GUIDES — PUBLIC BY DEFAULT

Unlike trips, which are private, Travel Guides are public. A travel guide starts with a form where you provide a name, a description, and a cover image; you may then add locations to the guide and set a cover image for each location. Everything you create in a Travel Guide — its name, description, cover images, and locations — is publicly visible and may be viewed, liked, and interacted with by any user who has a nakavo account. Do not include private, confidential, or sensitive information in a Travel Guide. You are responsible for ensuring you have the rights to all images and content you add, and that your Travel Guide complies with the Acceptable Use rules in Section 9.

A Travel Guide can be cloned into a trip. When you do this, a new trip is created in your account, and that trip is private — even though the public Travel Guide it was cloned from remains public.

9. ACCEPTABLE USE & PROHIBITED CONDUCT

nakavo is a travel community built on respect, and we want every part of the app to feel welcoming and safe. Bad language, hate, and any rude, impolite, or unsafe wording are not tolerated and are not accepted anywhere in the Service — including display names, bios, trip and travel guide names and descriptions, location details, photos, posts, comments, and any other content you create or share. You agree not to use the Service to:

  • Use profanity, vulgar, abusive, demeaning, or otherwise impolite or offensive language, or post any content that is rude or makes others feel unwelcome or unsafe, in any part of the Service;
  • Post, share, or transmit hate speech — content that promotes violence against, or discriminates against, individuals or groups based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or any other protected characteristic;
  • Harass, bully, threaten, or intimidate other users;
  • Upload content that is defamatory, obscene, or violates any applicable law;
  • Infringe the intellectual property rights of any third party;
  • Attempt to gain unauthorized access to other users' accounts or any part of the Service;
  • Use automated means (bots, scrapers) to access or collect data from the Service without our prior written consent;
  • Impersonate another person or entity.

Violations of this section may result in immediate content removal, account suspension, or permanent termination of your account, at our sole discretion, without prior notice.

10. INTELLECTUAL PROPERTY & USER CONTENT

You retain ownership of all content you upload to the Service ("User Content"), including photos, trip data, and documents. By uploading User Content that is made public (e.g. location photos, social posts, shared trips), you grant nakavo a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute that content solely for the purpose of operating and improving the Service.

You represent and warrant that you own or have the necessary rights to all User Content you upload, and that your User Content does not violate the rights of any third party.

11. ACCOUNT DELETION & DATA RETENTION

You may delete your account at any time directly from the nakavo app (Account → Settings → Delete Account) or by contacting us at [email protected].

Account deletion is permanent and irreversible. When you delete your account, we immediately begin the process of deleting your data, and we do not keep it for longer than necessary. This process is asynchronous, however, and it may take some time for all of your data to be fully removed from every part of the system. Upon deletion, your personal data, trips, attachments, and profile information will be removed. We do not retain your data beyond what is required by applicable law. Deleted data cannot be recovered. Content you previously shared publicly (e.g. shared trips cloned by other users) may persist in those users' independent trip copies.

12. DISCLAIMERS

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. NAKAVO DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. WE DISCLAIM ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

nakavo is not responsible for the conduct, content, or actions of other users on the platform, whether online or offline.

13. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, JONTAVO LTD AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF TRAVEL DOCUMENTS, OR LOSS OF PROFITS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

14. CHANGES TO THESE TERMS

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date at the top of this page, or by in-app notification where appropriate. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms.

15. GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
